Reminds Non-Audit Business and Professional Taxpayers of August 31 ITR Deadline

The Income Tax Department has reminded taxpayers earning income from business or profession whose accounts are not required to be audited that the due date for filing their income-tax return for Assessment Year 2026-27 is 31 August 2026. The reminder is particularly relevant to proprietors, professionals, partners and other non-audit taxpayers who fall in the August filing window.

 

Who falls in the August 31 filing window

 

The Department's official transition FAQs state that an assessee having income from profits and gains of business or profession whose accounts are not required to be audited under the Income-tax Act or any other law has a 31 August due date, subject to the stated conditions. The same table also covers a partner of a firm whose accounts are not required to be audited, and the spouse of such partner where the relevant clubbing provision applies.

This is different from the July 31 deadline that applied to the general non-business/non-professional category and from the later due dates that apply to audit and specified transfer-pricing cases. Taxpayers should therefore identify the return category and due-date bucket that actually applies to them rather than assuming a single deadline applies to everyone.

 

AY 2026-27 still follows the old Income-tax Act

 

The filing season is unusual because the Income Tax Act, 2025 came into force from 1 April 2026. However, the Department's official FAQs clarify that income earned from 1 April 2025 to 31 March 2026 is still reported for Assessment Year 2026-27 under the Income-tax Act, 1961. The move to the new tax-year framework applies to income earned from 1 April 2026 onward.

The official transition material also makes clear that taxpayers do not need to file two returns for the same FY 2025-26 income merely because the new Act has commenced. The AY 2026-27 return continues under the old framework, while the return for Tax Year 2026-27 will arise only after that tax year ends.

 

What taxpayers and professionals should check now

 

- Confirm the correct ITR form and due-date category. Business and professional taxpayers may fall under ITR-3, ITR-4 or another applicable form depending on legal status and income profile.

- Reconcile books and tax data. Review turnover or gross receipts, presumptive-income eligibility where relevant, TDS/TCS credits, advance-tax and self-assessment tax payments, and information reflected in the e-filing system.

- Check whether audit provisions apply. The August 31 deadline discussed here is specifically for the non-audit business/professional population covered by the official guidance. Audit cases follow a different filing timeline.

- Do not confuse AY 2026-27 with Tax Year 2026-27. The Department has expressly clarified the transition treatment, which is important when selecting the return period and interpreting forms.

 

Why the reminder matters

 

With the August 31 deadline only days away, CAs and tax teams handling non-audit business and professional returns should prioritise cases that are still awaiting data, reconciliations or tax payments. The practical risk is not merely late submission: last-minute filing can also increase the chance of mismatches, incomplete disclosures or incorrect form selection.

Taxpayers should rely on the Income Tax Department's e-filing portal and official guidance for the latest position, especially if any extension, utility update or additional filing advisory is issued close to the deadline.
